RUU Cipta Kerja Ubah Syarat Perizinan Operator Kereta Api
[14/10] Rancangan Undang-Undang (RUU) Cipta Kerja atau biasa disebut Omnibus Law yang saat ini menuai pro dan kontra mengatur tentang izin usaha sebuah perusahaan. Dalam salah satu pasalnya, RUU Cipta Kerja juga mengatur tentang perizinan sebuah perusahaan untuk menjadi operator kereta api.
Dikutip dari draf RUU Cipta Kerja, aturan tersebut tertuang dalam Pasal 56 angka 4 dan 6 RUU Cipta Kerja. Terdapat perbedaan yang drastis antara Pasal 56 RUU Cipta Kerja dengan Pasal 24, 32, dan 33 UU Nomor 23 Tahun 2007 Tentang Perkeretaapian yang mengatur tentang syarat sebuah perusahaan bisa menjadi operator prasarana dan sarana kereta api.
Singkatnya dalam Pasal 24 UU Nomor 23 Tahun 2007 sebuah perusahaan boleh menjadi operator prasarana kereta api umum apabila memiliki izin usaha, izin pembangunan, dan izin operasi. Sedangkan dalam Pasal 32 untuk menjadi operator sarana kereta api umum perusahaan harus memiliki izin usaha dan izin operasi. Dan dalam Pasal 33 untuk operator kereta api khusus perusahaan harus memiliki izin pengadaan atau pembangunan dan izin operasi.
Dalam Pasal 56 RUU Cipta Kerja, sebuah perusahaan hanya perlu memiliki izin usaha saja jika ingin menjadi operator prasarana dan sarana kereta api umum, ataupun kereta api khusus. Sedang ketentuan perizinan lebih lanjut menjadi diatur dalam Peraturan Pemerintah.
Rencana perubahan ini mengundang berbagai macam reaksi dari kalangan penggemar kereta api. Bagi kalangan yang mendukung, mereka berharap kemudahan perizinan bagi operator KA swasta akan mewujudkan adanya operator swasta yang dapat menghadirkan persaingan dengan KAI. Namun ada juga yang mengambil sikap berhati-hati karena tidak yakin keberadaan operator swasta dapat serta merta mewujudkan persaingan tersebut. (RED/BTS)
